HI, My name is Pankaj Mishra and I took a consumer durable loan from baja finserv lending my loan id is 5810CD00016164.I took a laptop from croma retail and the availed the loan of RS 17,388 from bajaj on 10 april 2012 . they set up a ECS on my kotak mahindra bank account and when i see the account online on http://www.bajajfinservlending.in/Pages/Personal.aspx?b=1 i see the ECS request for 5th of every month amonu 2975 When i took the loan i was told by the agent that there is an offer that after 3 installments i will be offered an Emi card where i will have facility to take instant loan without getting into hassle of documentation and he sold me an insurance as well. After three months talked to an agent in bajaj finance customer services(Tripti) regarding my EMI card and i was shocked to know when she said as my first installment got bounced due to insufficient funds and i will not be getting my emi card which was a bit shocking.Now what actually happaned ON 16th May i got the call the my ECS returned due to insufficients funds and i will be charged late fee and paymnet dishonour fee which would be rs 350 I was shocked as the money was there.I contacted my bank kotak mahindra to verify exactly what happaned why the ecs was returned when money was there and they confirmed no ECS has hit the account this month and they never received any request and they confirmed on 5th may the account balance was more than 5000 so there was no reason to disqualify th ecs of 2975.(it a zero bank account) that was really annoying on 17th May i got call from bajaj finance once gain and the guy(Gaurav) confirmed that he can send me the letter confirming that payment has dishonoured from kotak mahindra.i proposed him that we will take the bank into conference to clarify he said he will transfer the call to his senior i made the conference and the bank confirmed Naina(Mananger) who has talking to bank on behalf of bajaj finanace.the bank clearly confirmed her that no ecs has hit the account and on 5th may the account balance was more than 5000 so there was no reason to decline the paymnet.naina hung up saying that she will investigate and would get back to me in 1 hr but i never recieved any call after that i never delay in making my payment.i dont like being defaulter if the bajaj finance dint even try to take the paymnet then why m i liable to pay that extra 350 rs if i am not at fault. i attached my bank statement as well as a confirmation that ECs was nt hit and the money was there till 10th and mailed them. and later i talked to gaurav in bajaj finance and he sent me a apology letter and the guy came on 26th may and collected the installment in cash the issue got resolved.and now from the month of june they started taking regular payments . In july thats after my three installments when i called bajaj to know the status of my emi card as its been three installemnts she said its been cancelled as i am a defaulter. So once again i attached my statemnet for the period of 1st may to 15 th may.. shows clearly till 9th the account balance was more than 4000 so how on earth it will be dishonour due to insufficent fund and their manager Naina talked to kotak in conference and they confirmed no Ecs hit the account in may and i have attached my june statement as well the bank hasnt charge me anything else when a cheque gets bounced you see bank charges of 600rs in your next statment ..so i requested them check and tell as i am sure it was fault from your end so i shouldnt be penalised. I requested their management to look into it sincerely but its been 2 months i talked to different manager Rajni rao..naina...chetna..i dnt know how many executive and everytime they acknoweldge it but no resolution. its not just about an emi card its about business ethics. when bajaj dint attempt my bank account in may which has already been confirmed by RBI and kotak..how can they say that the payment was declined due to insufficient fund.....i am a deafaulter.....nd now i am not eligible to avail that facility.. that's fraud.... so i want to logde a complain through you sir in consumer court against bajaj finserv lending so that they dont do frauds like this with other consumer thanks if you need any documentsi am ready with them just lemme know you can call me back at 9811669812 0r 7503638964 if you need any clarification thanks
